Recognising the growing challenges faced by AI, the EU is looking to introduce some of the world’s first laws regulating AI and its use. What challenges does AI introduce, what rules is the EU looking to introduce, and does AI need regulation?

What challenges does AI introduce?

Over the past decade, AI has seen a substantial improvement in capability thanks to numerous technological advances and massive data available to train from. At the same time, AI is rapidly being integrated into numerous applications, ranging from autonomous systems, predictive maintenance, malicious software detection, and even personal assistants. But for all the benefits that AI presents, there are numerous challenges faced with its integration, especially in the realm of privacy, security, and legislation.

The EU's Approach to AI Regulation

The European Union has been proactive in addressing these challenges, aiming to establish a regulatory framework that ensures AI's safe and ethical use. This raises concerns about data use, storage, and protection. Instances of data breaches and unauthorised access to personal information have already highlighted the vulnerabilities in AI systems, something which was recently shown when employees of Samsung used ChatGPT to help with tasks, only to find that intellectual property had been submitted to ChatGPT and stored. As such, striking a balance between the collection of data for AI training and protecting individuals’ privacy is crucial for ensuring public trust and acceptance of AI technologies.

In addition to privacy, the EU is also focusing on promoting transparency in AI systems. The European Parliament has expressed its desire for AI systems to be transparent and understandable, which is crucial for building public trust and ensuring that AI is used responsibly [5].

Discrimination and Bias

AI algorithms are only as good as the data they are trained on, but if training data is biased, then the resulting AI will amplify those biases. If not carefully maintained, it is possible for AI to discriminate unfairly, leading to biased outcomes in critical areas such as hiring, lending, and law enforcement. Researchers and developers must work towards building more inclusive and diverse training datasets, employing techniques like explainable AI and fairness metrics to address discrimination concerns.

However, it is also essential that training data isn’t manipulated to try to create an unrealistic interpretation of the world. This is particularly dangerous for medical data where different ethnicities, genders, and physical characteristics do, in fact, have an effect on diagnosis and treatment.

Another significant challenge is the issue of AI explainability. As AI systems become more complex, understanding the decision-making process of these systems becomes increasingly difficult. This lack of transparency can lead to mistrust and potential misuse of AI technologies. The EU is aware of this challenge and is working on measures to ensure that AI decisions can be explained and understood by humans, as highlighted in the European Parliament's report on AI threats and opportunities [3].

Law Enforcement and Ethical Dilemmas

The use of AI in law enforcement presents unique challenges that require careful consideration. Facial recognition technology, predictive policing algorithms, and automated decision-making systems are increasingly being employed in an effort to reduce crime rates and increase police efficiency. However, these technologies raise concerns about false positives, racial profiling, and the erosion of due process. 

Striking a balance between public safety and individual rights is crucial, especially when considering that individual freedoms and rights are the essence of a functioning society. Establishing transparent guidelines, robust oversight mechanisms, and accountability frameworks is imperative to ensure AI technologies in law enforcement operate within ethical boundaries and protect civil liberties.

Security Risks

As AI systems become more sophisticated, they also become attractive targets for cybercriminals and malicious actors. Adversarial attacks can manipulate AI algorithms to produce incorrect or malicious outputs, causing significant harm. Furthermore, the increasing reliance on AI in critical infrastructure, such as autonomous vehicles and healthcare systems, raises concerns about the potential for cyber-physical attacks. Strengthening the security of AI systems through robust encryption, secure data handling, and continuous vulnerability testing is vital to safeguard against these emerging threats.

What rules are the EU looking to introduce?

Recognising the fast speed at which AI is becoming integrated into society, the EU has decided to take steps that will see it introduce some of the world’s first legislation for AI. It is hoped that by introducing legislation now, AI can continue to be rapidly developed while providing guidance and rules that prevent it from quickly being abused. Furthermore, by introducing legislation that limits what AI can be used for, there is no need to halt current AI development and deployment to decide if and how AI should be used.

So far, the proposed legislation has outlined how AI can be used in medical diagnostic applications, drones, and generated content. However, the most interesting aspect of the legislation is that it aims to introduce a blanket ban on police forces using AI to identify suspects in public spaces. While AI can be used to help find wanted criminals and missing persons, there are grave concerns with regard to racial bias and breach of privacy, especially when considering that a facial recognition system would be analysing every public individual (thus, making them all potential suspects).

The EU's approach to AI regulation also extends to data sharing, with the aim of boosting innovation and the competitiveness of the EU economy[10]. The Data Governance Act, for instance, seeks to create trust in data sharing, ensuring it is safe, easy, and in line with data protection legislation[10].

With regard to copyrighted material, the proposed legislation will require AI developers to publish all the works of those involved with the data used to train the AI (such as musicians, scientists, and photographers). Any company that doesn’t comply with this requirement would be required to either shut the system down or incur a 7% revenue fine. 

The EU's Stance on AI and Cybersecurity

The EU is also aware of the security risks posed by AI. The European Parliament has been proactive in addressing cybersecurity threats, introducing new laws to combat cybercrime[9]. These laws aim to strengthen the EU's resilience and response to cyber-attacks, protecting critical infrastructure, including AI systems, from potential threats[9].

The EU's proposed regulations also extend to specific sectors. For instance, in the healthcare sector, AI has the potential to revolutionize diagnostics and treatment. However, it also raises ethical and privacy concerns. The EU is working on rules to ensure that AI is used responsibly in this sector, protecting patient data while also harnessing the potential of AI to improve healthcare outcomes [1]

Does AI need regulation?

While the proposed legislation has garnered support from many EU parliament members, it has also met with resistance and doubt. Critics argue that over-regulation could stifle innovation, making the EU a less attractive hub for AI startups. They also express concerns that restrictions on AI use in law enforcement could hinder efforts to quickly identify and apprehend dangerous criminals. One primary concern that seems to arise is that by limiting AI’s use in law enforcement, police will not be able to rapidly identify potentially wanted dangerous criminals who often go on to commit crimes until they are caught.

Another concern behind the legislation is that it could make the EU an undesirable place for AI start-ups, whereby numerous data may have to be publicly published, and AI that doesn’t conform to the requirements can see large fines. Considering that AI is clearly the next forefront of technology, denying its use in society and limiting what it can do is a fast way to fall behind. 

The EU's proposed regulations also consider the digital market's dynamics. The Digital Markets Act and the Digital Services Act aim to create a safer, fairer, and more transparent online environment[11]. These landmark digital rules, adopted in 2022, seek to address the imbalance created by the dominant position of some digital platforms[11].

But does AI need legislation? For now, having some level of legislation can’t hurt, especially when the technology is still young, and humanity is trying to figure out how it will impact lives. However, outright resisting its integration is dangerous, as hostile nations will likely take advantage and develop their own AI at alarming rates. 

The EU's approach to AI regulation is not just about mitigating risks but also about harnessing AI's potential for innovation and economic growth. The EU recognises the opportunities presented by AI, such as its role in shaping the digital transformation of the EU[2] and its potential to create new jobs and drive economic growth[7].

In fact, the European Parliament has expressed its desire to protect online gamers, a community that often interacts with AI technologies[12]. They aim to ensure a safer environment for players, address problematic purchase practices, and better protect children and vulnerable groups[12]. This shows the EU's commitment to creating an inclusive and safe digital environment for all its citizens.

AI and the Digital Economy

The EU's approach to AI regulation also recognises the role of AI in the broader digital economy. For instance, the EU has been proactive in addressing the challenges and opportunities presented by cryptocurrencies[8]. While cryptocurrencies are not directly related to AI, they are part of the broader digital transformation that is reshaping economies and societies. The EU's approach to cryptocurrencies, which includes both regulatory and supportive measures, provides a useful context for understanding its approach to AI[8].
